MEETING WITH MINING ENTERPRISES

With the purpose of coordination to increase the performance of the mining sector, to strength the mining enterprises, to increase production, social and environmental care and to increase revenue for the state and citizens, the Independent Commission for Mines and Minerals, within the powers it has, today on 08.02.2018 has organized the second informative meeting after the one that was held on 04.12.2017 regarding the Law on Mines and Minerals, Administrative Instructions, Regulations and other subnormative act that regulates the mining activities in the Republic of Kosovo.

Participants to this meeting by the ICMM were the member of the ICMM Board Mr Festim Kutllovci, Director Mr Ramiz Krasniqi, Chief Inspector Mr Fatmir Gërguri, as well as the presenters Mr Jahir Gashi, Mr Axhif Axhami, Mr Sali Mulaj and Mrs Selvije Kadriu.

The purpose of holding the meeting was to inform the enterprises licensed by the ICMM with the manner, forms and procedure of reporting in the ICMM.

The Independent Commission for Mines and Minerals – ICMM is an independent agency determined by the Constitution of the Republic of Kosovo. The ICMM shall regulate mining activities in Kosovo in accordance with the Law No. 03/L-163 on Mines and Minerals amended and supplemented by the Law No.04/L-158, the subnormative acts issued pursuant to the present law and the Mining Strategy. The ICMM shall act in the public interest and independently exercise the powers and carry out the functions assigned to it by the Law on Mines and Minerals.

 

The Law on Mines and Minerals, except the rights that it gives to enterprises in order to operate, also foresees obligations. Obligations foreseen by the Law on Mines and Minerals are also reporting for the Mining Licenses and Special Operation Permits.

Quarterly reports:

The Law on Mines and Minerals article 34 paragraph 4.1 foresees that enterprises possessing a Mining License must submit within thirty (30) days upon completion of each quarter, a report of the volume of minerals produced, and a statement showing the amount of the royalty during that quarter.

Annual reports:

The Law on Mines and Minerals article 34 paragraph 4.2 foresees that enterprises possessing a Mining License shall submit within 60 days upon completion of each calendar year:

  • a report for such calendar year providing: a summary of the results of all mining operations; precise details on the tonnage, volume, composition, grade and value of minerals produced etc.
  • audited statements for such calendar year on expenditures;
  • an audited statement showing the amount of the royalty that has been determined to be payable in respect of previous calendar year,
  • an audited financial report showing the profit and loss and the state of the financial affairs of the Licensee at the end of such calendar year.

Reporting is a legal obligation foreseen by law. In cases where enterprises do not report on time, then it shall impose Administrative Penalties and Mandatory Penalties according to Administrative Instruction (ICMM No. 02/2012).

In order to raise awareness, offer opportunities and to reduce penalties in this way the ICMM provides assistance to enterprises. It has issued a decision No.1554 dt. 20.04.2017 in order to give additional deadline to enterprises, first sending notices for not reporting and then Decision on Suspension and Administrative Fine.

The enterprises were informed at this meeting about the forms of reporting and the obligations deriving from the Law on Mines and Minerals.

Enterprises have shown high interest to participate at this meeting and also they highly appreciated this informative meeting and the ICMM’s readiness to increase cooperation with enterprises.

This meeting was held in the big hall in the building of the Ministry of Public Administration (former Rilindja building) in Pristina in the presence of the media.
